Building Near Water? A Soil Erosion Permit may be needed.


You need a Soil Erosion and Sedimentation Control Permit (SESC permit) if you are disturbing land which disturbs more than one (1) acre and/or within 500 feet of the waters edge. Waters edge includes lake, streams, and rivers.

SITE PRIORITIZATION MATRIX

The Matrix is intended to provide an overview for how sites are prioritized for inspection in Clare County.  However, the Clare County Enforcing Agency reserves the right to use additional criteria (i.e. soil types, slope, type of resources at risk, and past performance of permittee or contractor) as mitigating circumstances when deciding whether a site is High, Moderate, or Low Priority.

At a minimum, all sites will be inspected prior to permit issuance and prior to termination or expiration of the permit.

Site Prioritization Matrix for Clare County:

HIGH Priority (inspection at least 1 time every 2 weeks of open permit)

Earth disturbance is over 10 acres of contiguous land and has direct connection (immediately adjacent to or point source discharge to) surface waters or adjacent property.

MODERATE Priority (inspection at least 1 time every month of open permit)

Earth disturbance is over 10 acres of contiguous land with no direct connection (immediately adjacent to or point source discharge to) surface waters or adjacent property. OR under 10 acres and with in 500 feet of surface waters.

LOW Priority (inspection at least 1 time every 2 months of open permit)

Earth disturbance between 1 and 10 acres of contiguous land with no direct connection (immediately adjacent to or point source discharge to) surface waters or adjacent property.
